1. Agreement
These terms are a contract between you and Ryblusoft, S.A.S. de C.V., [street address], Naucalpan de Juárez, Estado de México, C.P. [postal code], Mexico (“Ryblusoft”, “we”). They apply to ryblusoft.com, the waitlist, and the PumpFlow app on iOS and Android (the “Services”). By using the Services you accept them. Our Privacy Policy explains how we handle your data and is part of these terms.
2. Who can use the Services
You must be at least 18 years old and able to enter a contract. One account per person. You may enter details about a baby only as their parent or legal guardian.
3. PumpFlow is not medical advice
PumpFlow records and organizes the information you enter. It does not diagnose, treat or advise on any medical condition. Its statistics, reminders and content are not a substitute for a doctor, pediatrician or lactation consultant. If you are worried about your supply, your health or your baby’s health, talk to a professional. In an emergency, call your local emergency number.
4. Your account
Keep your login details private and tell us at once if you think someone else has used your account. You are responsible for what happens under your account until you tell us. Give us accurate information and keep it up to date.
5. Work in progress and beta features
The Services are in active development. Features may change, be removed or fail, and beta versions may lose data. We will warn you before a change that could delete your data and give you a way to export it. We do not promise that any part of the Services is available at a given time.
6. Price
The Services are free today. If we introduce paid features, we will announce them in the app with at least 30 days’ notice, and billing will go through the App Store or Google Play under their rules. Free features you already use will keep working, or we will tell you what changes.
7. Your content and data
Everything you enter — sessions, notes, baby details — stays yours. You give us a licence to store, process and display it only to run the Services for you. We do not claim ownership of your data and we do not use health data for advertising. You can export and delete your data at any time (see the Privacy Policy).
8. Acceptable use
Do not: use the Services for anything unlawful; try to access other people’s accounts or data; reverse-engineer, scrape or overload the app or site; upload malware; or use the Services to harass anyone. We may suspend an account that breaks these rules after notifying you, except where the law or safety requires immediate action.
9. Our content
The PumpFlow app, the Ryblusoft name and site, and the Studio’s series and artwork belong to Ryblusoft or its licensors. You may use the app and watch our content for personal, non-commercial purposes. You may not copy, resell or redistribute them. Our short series are published on TikTok, Instagram and YouTube under those platforms’ terms; share clips with the platforms’ own sharing tools.
10. App store terms
If you downloaded PumpFlow from the App Store or Google Play, Apple and Google are third-party beneficiaries of these terms and may enforce them. Apple and Google are not responsible for the app, its maintenance, support or any claim about it; those are our responsibility. You must also follow the App Store or Google Play terms that apply to you.
11. Ending the relationship
You can stop using the Services and delete your account at any time. We can suspend or close your account for a serious breach of these terms, or if we shut down a Service; in that case we will give you at least 30 days’ notice and a way to export your data, unless the law prevents it.
12. Warranties and liability
The Services are provided as they are, without warranties beyond those the law requires. To the extent the law allows, Ryblusoft is not liable for indirect losses, for lost data you could have exported, or for decisions you take based on the information in the app. Nothing in these terms limits the rights you have as a consumer under Mexican law, including the Ley Federal de Protección al Consumidor, or under mandatory law where you live.
13. Governing law and disputes
These terms are governed by the federal laws of Mexico. Disputes go to the competent courts of Naucalpan de Juárez, Estado de México, unless mandatory consumer law gives you another venue. Consumers in Mexico may also file complaints with PROFECO. Before suing, write to us; most problems are solved by email.
14. Changes
We may update these terms. We will show the new version in the app and on the site with its date, and for material changes we will ask you to accept them before you continue.
